Bid Protest Procedures
A bidder who wishes to file a protest pertaining to a bid must file such notice in accordance with procedure prescribed by 120.57 (3) FS.

Step #1: In the case of a protest of the specification of an invitation to bid or request for proposal, the vendor shall file with the authority issuing the bid or request for proposal a notice of protest in writing within seventy-two (72) hours after receipt of the specifications and shall file a written formal protest identifying the bid number, title, and basis for the protest within ten (10) days after the date of the notice of protest.

In the case of a protest of the bid award, the vendor shall file with the authority issuing the bid or request for proposal a notice of protest in writing within seventy-two (72) hours after posting of the recommended award, and shall file formal written protest identifying the bid number, title, and basis for the protest within ten (10) days after the date of the notice of protest.

The issuing authority will provide a written response to the protesting vendor within seven (7) days working business days after receipt of the formal written protest.

Step #2: The vendor may appeal to the City Manager within seven (7) working business days following a decision by the issuing authority.

Step #3: The vendor may appeal to the City Commission within seven (7) working business days following the City Manager's decision.

Appeal to the City Commission is the final step within the City of Wauchula's administrative process and their decision is final. Vendors are responsible for following the progress of their bids or appeal. Bid awards shall be posted in the Purchasing Office and available for public review.
